A family member may obtain an order for protection from the court for himself or herself, or on behalf of a minor family household member.

Domestic abuse includes:

  • Physical harm, bodily injury, or assault between family or household member.
  • Terrorist threats or criminal sexual conduct committed against a family or household member by a family or household member.
  • Interfamilial sexual abuse committed against a minor family or household member by an adult family or household member.

If the petition for an order for protection alleges an immediate and present danger of domestic abuse, the court may grant an ex parte order for protection and may consist of:

  • Restraining orders that prevent the abusing person from committing acts of domestic abuse.
  • Excluding the abusing party from the home they share with the victim.
  • Excluding the abusing party from the place of employment of the victim or restricting access to the victim by the abusing party at the victim's place of employment.
